Assessing the Odds of SEC’s Win Against Ripple: Attorney Fred Rispoli’s Insights
Attorney Fred Rispoli recently shared his thoughts on the likelihood of the SEC’s success in the ongoing legal battle against Ripple during an appearance on the “Thinking Crypto” podcast.
Rispoli emphasized that the outcome of the case will heavily depend on the panel of three judges assigned to handle the appeal. He pointed out that the composition of the panel could range from favorable to unfavorable for the SEC, significantly impacting their chances of winning.
According to Rispoli, if the panel has a history of siding with the government on legal matters, the SEC’s probability of winning could be as high as 70% to 80%. However, he expressed confidence in Ripple’s ability to overcome the challenges posed by the SEC.
During the interview, Rispoli highlighted the risks faced by both Ripple and the SEC in the appeal process. He noted that Ripple is likely to contest all the rulings it disagrees with, with particular emphasis on the programmatic sales issue. This aspect is considered crucial as it directly impacts the legal status of XRP, potentially affecting not only Ripple but also other cryptocurrency companies like Coinbase and Kraken.
Furthermore, Rispoli predicted that the SEC would seek to appeal the penalties imposed on Ripple, aiming for a higher fine in the final judgment. He also emphasized the importance of Ripple maintaining the support of its clients and institutional investors throughout the appeal process.
