Montenegro’s Constitutional Court has once again postponed the extradition of Do Kwon, following an appeal from Kwon himself. This decision has halted the Supreme Court’s ruling, which previously left the Minister of Justice with the final authority on the matter.
According to the official website of the Constitutional Court of Montenegro, the court has granted a request to delay the extradition process until a final decision is reached by the Constitutional Court. This comes after Kwon’s legal team filed an appeal on September 25 against the Supreme Court’s ruling, with the Ministry of Justice only becoming aware of this appeal recently.
The court’s decision has effectively suspended the Supreme Court’s ruling from September 19, which in turn suspended the Minister of Justice’s decision on whether Kwon should be extradited to South Korea or the US. The Ministry of Justice has called for a swift resolution from the Constitutional Court, so that they can proceed with the necessary actions in this case.
Minister of Justice Bojan Božović had previously announced that he had made a decision on Kwon’s extradition location, with plans to reveal it by the end of the week. However, with the latest postponement, this marks the third time that a decision on Kwon’s extradition has been delayed, adding to the six appeals that have been submitted in total.
The Supreme Court’s ruling in September declared previous judgments from the High Court and Appellate Court as invalid, leading to the current legal battle over Kwon’s extradition.
