Judge Katherine Polk Failla of the Southern District of New York has made a significant decision by denying the motion to dismiss the charges against Tornado Cash co-founder Roman Storm. Storm is facing legal troubles due to allegations that Tornado Cash developers assisted the North Korean hacking group Lazarus in laundering illegal funds through the crypto mixer.
In an attempt to have the case dismissed, Storm’s legal team argued that the developer simply created an open-source protocol that offered privacy solutions for users of the Ethereum network, which they claim is not a criminal offense. However, DeFi Education Fund chief legal officer Amanda Tuminelli revealed that Failla was not convinced by this argument.
During the US v. Storm (Tornado Cash) hearing, Failla rejected Storm’s motion to dismiss as a matter of law and emphasized that factual issues would be addressed during the trial. Tuminelli explained that Failla denied the motion because the case revolves around Storm’s state of mind rather than simply the lines of code he wrote.
According to Tuminelli, the government does not have to prove that Storm conspired with any user or was aware of specific criminal activities. Instead, they need to demonstrate that Storm knew he was dealing with the proceeds of a crime. Crypto venture fund Variant chief legal officer Jake Chervinsky expressed his concerns, labeling the ruling as an attack on the freedom of software developers worldwide.
Chervinsky believes that this decision will be remembered as a distortion of the law and a miscarriage of justice. Storm is set to face trial in December, where the evidence of his state of mind will be a key factor.
