Disgraced FTX founder Sam Bankman-Fried is making a bold move by calling for a new trial, citing unfair treatment and bias throughout his legal battle. In a recent filing with the US Court of Appeals for the Second Circuit, Bankman-Fried’s lawyers argue that the trial, presided over by Judge Lewis A. Kaplan, was marred by one-sided rulings and ridicule towards their client.
The lawyers claim that Judge Kaplan showed little objectivity and even-handedness during the proceedings, going as far as to make disparaging comments about Bankman-Fried in front of the jury. They argue that the trial was anything but fair, as everyone had already presumed Bankman-Fried’s guilt, from the media to federal prosecutors and even the judge himself.
Bankman-Fried is now seeking to have the case remanded for a new trial with a different judge. This comes after Judge Kaplan handed down a harsh sentence of 25 years in prison and three years of supervised release, along with a staggering $11 billion forfeiture, for Bankman-Fried’s involvement in a scheme that diverted over $8 billion in FTX customer funds to his trading firm, Alameda Research.
In response to his conviction and sentence, Bankman-Fried filed an appeal in April in an effort to overturn the decision. The outcome of this appeal remains to be seen, but Bankman-Fried is determined to fight for his innocence and fair treatment in the legal system.
